Can a foreigner work legally in Argentina?
Last verified: 27 Oct 2026 · Status: Changing
Short answer. Yes, if the person holds a residence that allows work. Permanent residents may do any paid work. Temporary residents may work during their authorised stay, and a provisional residence can allow work while the application is pending. Tourists may not work. An employer who hires someone without authorisation faces a fine of 50 minimum wages per worker.
As of 26 Oct 2026. Rules in force at that date.
Key rules
- Work rights follow the residence category. Permanent residents may do any paid activity, employed or self employed; temporary residents only "during the period of their authorised stay" (Law 25.871, art. 51). Transitory residents, including tourists, may not do paid work unless the National Directorate of Migration (DNM) expressly authorises it, except seasonal workers (art. 52).
- While the application is pending. The DNM may grant a provisional residence ("residencia precaria") of up to 90 calendar days, renewable, which lets the holder work (art. 20, as replaced by DNU 366/2025, art. 4). Art. 52 says holders "may be enabled to work" on DNM terms, so check the precaria itself.
- No residence, no work. An irregular foreigner, or a regular one without authorisation, may not work in any form. Overstaying makes a person irregular (art. 53, as replaced by DNU 366/2025 art. 12).
- Work routes. Migrant worker contract (art. 23 a), specialised or transferred staff (art. 23 e), Mercosur nationality (art. 23 l, two years, no job offer needed).
- Employer duties. Nobody may give paid work to an irregular foreigner (art. 55). Fine: 50 SMVM per unauthorised worker, 100 for minors, up to 50% more for repeat offenders, never below 2 SMVM, jointly and severally (art. 59). Wages and labour obligations remain owed (art. 56; LCT arts. 40 and 42). The DNM may inspect employers (art. 53 bis).
- Sponsor register. Sponsors of art. 23 a or e residences must register in RENURE (DNM Disposition 3043/2020, art. 2) and report a no show or the end of the job within 10 calendar days (art. 12 b), or face suspension of at least 3 years (art. 15). The DNM may require a guarantee of 2 to 10 SMVM (Decree 616/2010, art. 73).
- CUIL. ANSES issues the employee's CUIL free, in person, without an appointment; without a DNI, the DNM file showing the residence type is accepted (ANSES, Obtener CUIL).
What changes the answer
- Mercosur nationality. No RENURE sponsor (art. 23 l is not listed in Disp. 3043/2020 art. 2); fee 50 UMSM, not 100.
- Tourists. Up to 3 months, extendable for a similar period, no paid work (Decree 616/2010, art. 24 a).
- Digital nomads. Visa exempt nationals may get up to 180 days, extendable once, for remote services only to persons or companies domiciled abroad (DNM Disposition 758/2022, arts. 1 and 3; DNM nomad page).
- Remote work for a foreign employer as a tourist. No rule found allows it. Art. 52 bans paid work by transitory residents whoever pays, and the DNM said the tourist category does not fit remote workers (Disp. 758/2022, recitals). Enforcement is not sourced (unconfirmed). Law 27.555 art. 17 applies the more favourable of Argentine or employer law to cross border telework; its rule on hiring non residents was never regulated (Decree 27/2021, art. 17), and Law 27.555 is repealed from 1 Jan 2027 (Law 27.802, art. 199).
Worked examples
A CABA SAS hires a non Mercosur developer as an art. 23 a migrant worker through the DNM corporate channel. Pesos are converted at the dólar MEP rate of ARS 1,563.90 per US$ on 23 Oct 2026, as given in some secondary summaries (unconfirmed) (see /data/mep/).
| Step or item | Time | Cost ARS | Cost USD |
|---|---|---|---|
| 1. Register the SAS in RENURE (note signed before a notary) | Not published (unconfirmed) | No fee found (unconfirmed); notary fee not sourced (unconfirmed) | n/a |
| 2. Pre contract with notarised signatures; documents apostilled and translated abroad | Before filing | Not sourced (unconfirmed) | n/a |
| 3. Residence fee, non Mercosur (100 UMSM) | At filing | 100,000 | 63.94 |
| 4. Corporate channel urgent fee (100 UMSM) | At filing | 100,000 | 63.94 |
| 5. Argentine criminal record certificate, 24 hours | 1 business day | 2,400 | 1.53 |
| 6. DNI for foreigners, first issue | Paid in RaDEx (unconfirmed) | 20,000 | 12.79 |
| 7. CUIL at ANSES | Same day, walk in | 0 | 0.00 |
| 8. ARCA registration ("alta") | By the day before work starts | 0 | 0.00 |
| Total official fees | 222,400 | 142.21 |
Step by step.
- The SAS registers in RENURE once (Disp. 3043/2020 arts. 2, 3, 10); the DNM worker page still cites "Disp. DNM 54.618/08". The developer enters regularly and does not work yet (art. 52).
- The developer files in RaDEx through the corporate channel: 100 + 100 UMSM at ARS 1,000 = ARS 200,000 (Decree 584/2024, art. 2; DNM fee table). The criminal record certificate (ARS 2,400) is bought separately.
- A precaria may allow work from filing (art. 20).
- CUIL from ANSES, then ARCA registration by the day before work starts (AFIP RG 2988/2010, art. 3 b). The alta temprana goes to the DNM within 30 calendar days of filing (DNM worker page).
- Appointment within 5 business days of closing the online file; decision within 5 business days of biometrics (RaDEx corporate).
- One year residence, renewable for 100 UMSM (DNM worker page). Total: 200,000 + 2,400 + 20,000 = ARS 222,400 (US$142.21).
Cost to do it: fees ARS 222,400 (US$142.21). Capital: none, but a possible 2 to 10 SMVM guarantee, ARS 782,400 to 3,912,000 (US$500.29 to 2,501.44) at the SMVM of ARS 391,200 from 1 Oct 2026 (CNEPSMVM Res. 4/2026, art. 1 b). Months: about two weeks once the file is complete, plus unpublished RENURE time (unconfirmed). Work before the precaria risks a fine of ARS 19,560,000 (US$12,507.19).
Practical traps
- Expiry ends work rights. Overstaying makes the worker irregular (art. 53 c), triggering art. 59.
- ARCA registration is not a work permit. It suffices for labour law (LCT art. 52), not for Law 25.871.
- A CDI is not a CUIL. It cannot be used for tax or social security obligations (ARCA CDI page).
FAQ
Can a foreigner start work the day after filing? Only with a precaria or residence that allows work (arts. 20, 52, 53).
Can a digital nomad invoice an Argentine company? No. The residence covers clients domiciled abroad only (Disp. 758/2022 art. 1).
Which minimum wage sets the fine? The law does not say: infraction date or decision date (unconfirmed).
Can the worker change employer? Art. 51 ties work to the stay, not an employer. Whether a sponsored worker must refile is unsettled (unconfirmed).
